Article 1. General provisions


Karen Swami has set up an online store that offers for sale some of her products, subject to availability. Each piece is original. 


The Karen Swami online store is exclusively intended for orders placed by customers on a personal basis.


The term "Sales Order" shall designate a commitment to purchase all Products selected by the Customer via the Internet Boutique's e-commerce service.


The term "customer" refers to non-commercial natural persons purchasing products for their personal needs or legal entities purchasing products for needs not related to their professional activity.


Purchase for resale or any other commercial purpose is not permitted.

Article 2. Scope of application


These General Terms and Conditions of Sale (the "GTC") apply to all orders made to Europe and International. 


These General Terms and Conditions exclusively govern the offer and acceptance of orders for the purchase of products as well as the payment and delivery of products ordered by customers on the online store.


The customer expressly and irrevocably accepts the terms of these GTC when he validates his order.


The customer accepts that the proof of acceptance of the GTC is characterized by ticking the mention "I have read and accept the General Terms and Conditions of Sale".


The GTC applicable to the customer are those he accepted at the time of placing his order.


Karen Swami reserves the right to change her GTC at any time.


The customer has the right to print, download and store a copy of these GTC on paper and electronic media.







Article 3. Products


3.1 Presentation and description of products


Each product is accompanied by a description and one or more visuals to which the customer has access by clicking directly on the product.


Karen Swami makes every effort to ensure that the descriptions and visuals represent the products offered for sale as faithfully as possible. However, Karen Swami cannot guarantee a perfect similarity of the descriptions and visuals with the product sold, especially with regard to colors.


The visuals and descriptions of the products can in no way engage the responsibility of Karen Swami and give right to any claim on the part of the customer.


3.2 Selling price



The prices and offers indicated on the online store are valid as long as they are displayed on the site. Sales prices are inclusive of all taxes, excluding delivery and customs fees. 


Any delivery costs (article 4.5) are the responsibility of the customer and are invoiced in addition to the sale price of the products.


Prior to the final validation of the order, the customer has access to the total amount of his order, which includes the related taxes and possible delivery charges, excluding customs taxes. 


Price change

Karen Swami reserves the right to change its prices at any time.


Any change in the rate of value added tax (VAT) will be immediately reflected in the price of the products sold.


Price error

Karen Swami makes every effort to display the exact prices of the products, but it may exceptionally happen that products are incorrectly priced.


In this case, Karen Swami will contact the customer and, according to his instructions, will give him the possibility to confirm his order at the actual price or to cancel it.


3.3 Product availability

Karen Swami always strives to satisfy her customers' orders.


Cependant, dans l’hypothèse où tout ou une partie des produits serai(en)t indisponible(s) et/ou non réapprovisionnés, le client sera informé par Karen Swami dans les meilleurs délais de la possibilité de remplacement de son produit ou de la faculté d’annuler sa commande.


In case of explicit cancellation, the customer will be refunded the amount debited to his bank account within a maximum of 14 days.




Article 4. Terms of order and payment

4.1 Ordering


While browsing the online store, the customer takes note of the products offered for sale and selects the product(s) he or she wishes to order by clicking on "Add to cart".


The customer can also decide to purchase additional products by clicking on "Continue Shopping".


At any time the customer can click on the "My cart" tab in order to view the selected product(s).


The customer must then click on "Place my order" in order to finalize his order.


The customer then has the possibility of checking and correcting his order by looking at his "Order Summary", before definitively validating it.


4.2 Creating a customer account


To facilitate his order and future orders, the customer has the possibility to create a personal account.


This account will allow him/her to identify him/herself automatically with each new order, provided that he/she enters his/her login and password.


All he has to do is register in the "I create my account" section by filling in the detailed fields.


The customer may at any time change his personal information (password, address, ...).



4.3 Confirmation of the order


Once the shopping cart has been checked and the customer's personal information has been filled in, the customer is invited to click on "Validate" to submit the order.


Any validated order becomes final and thus entails full and complete acceptance of these GTC by the customer.


4.4 Payment of the order


The payment of the order is only made online by credit card CB, Visa, Mastercard or American Express. Payment is secured by PayPal. It is thus also possible to pay with one's PayPal account, if the customer has one. 


In order to proceed with payment, the customer must enter his credit card number, expiration date and the visual cryptogram located on the back of the card in the fields provided for this purpose.


The customer's bank account or PayPal account will be debited after a maximum period of seven (7) days after order confirmation.


4.5 Delivery costs


Karen Swami entrusts to the company DHL, deliveries in France, Europe or International. Delivery costs are calculated at the time of the order and are to be paid by the customer. 

Concernant les frais de douane, il n’est pas possible d’anticiper ces éventuels frais. Le client accepte expressément en validant les présentes conditions générales de vente, de prendre entièrement à sa charge les éventuels frais de douane et taxations locales.


4.6 Refusal of order or purchase cancellation


Karen Swami reserves the right to refuse an order or cancel a purchase for just cause, in accordance with article L. 121-11 of the Consumer Code.


Refusal to accept an order or cancellation of a purchase for just cause does not give rise to any compensation but to the reimbursement of the price of the products.


Refusal of order or cancellation of purchase can take place for the following reasons:


  • Unavailability of products
  • Impossibility to execute the order and/or delivery (incomplete contact information or delivery address)
  • Order likely to be intended for resale
  • Wrong selling price
  • Fraudulent use of bank data
 5.2 Terms of delivery


Karen Swami strives to deliver the customer within a maximum of fifteen (15) working days.


In the event of the customer's absence at the time of delivery, a calling card will inform the customer of the terms and conditions of storage and availability of his package.


In the event of an incomplete or erroneous delivery address, the costs of reshipping the package will be borne by the customer.


The customer assumes full responsibility for the products from the moment they are received.


5.3 Delivery problems


Any delay in shipment or delivery will be communicated to the customer by e-mail.


Upon delivery, the customer is required to check the condition of the packaging of his package and the conformity of the products ordered. In case of apparent deterioration, it is recommended that the customer refuses to accept the package from the carrier. The customer must then notify his reservations to the carrier and Karen Swami.


Karen Swami cannot be held responsible for any delay in delivery due to unavailability of the customer after several proposals for appointments with the carrier, or due to an error attributable to the carrier.
